Friends of Four Marks School PTA – Firework Display Ticket Terms and Conditions

1. Event, tickets, changes and cancellation
Event timings: Gates open at 5:00 pm and the firework display is scheduled to begin at 6:30 pm. Attendees should arrive in sufficient time for ticket scanning and any proportionate security checks. The organiser may delay timings where reasonably necessary for safety or operational reasons.
Ticket sales and transfers: Tickets may not be resold for more than their face value. A ticket may be transferred or gifted to another person provided it has not already been used, duplicated, cancelled or refunded. Except as stated in these terms or required by law, tickets are non-refundable and non-exchangeable.
Weather: This is an outdoor event and may proceed in rain or other poor weather. Attendees should dress appropriately. The organiser may delay, shorten, suspend, postpone or cancel all or part of the event where weather, safety advice, an emergency or circumstances outside its reasonable control make this necessary.
Cancellation, postponement and material changes: If the organiser cancels the entire event before gates open, ticket holders will receive a refund of the ticket price and any booking fee retained by the organiser. Any fee retained solely by an independent ticketing platform will be dealt with under that platform’s terms, subject to applicable law. If the event is postponed, ticket holders may use their tickets for the rescheduled date or request a refund within the period notified by the organiser. If the event is abandoned after gates open, materially shortened or materially changed, the organiser will consider an appropriate full or partial refund having regard to the part of the event already provided and the reason for the change. No refund is payable merely because an attendee chooses not to attend, arrives late or leaves early.
Programme and attractions: Advertised vendors, rides, entertainment and facilities may change or be unavailable. The organiser will use reasonable efforts to deliver the main firework display but does not guarantee that every ancillary attraction will be available. Nothing in these terms affects any remedy available where a change is material.
Acceptance of terms: By purchasing, accepting or using a ticket, the ticket holder agrees to these terms. A purchaser buying tickets for other people must make these terms available to them before the event.

2. Entry, age restrictions and security
Children: Every child under 16 must be accompanied and supervised throughout the event by a responsible adult aged 18 or over. Unaccompanied children may be refused entry. The accompanying adult remains responsible for the child’s welfare and conduct.
Security searches: To protect attendees and staff, the organiser may carry out proportionate searches of bags and outer clothing as a condition of entry. Searches of a person will be conducted respectfully and with consent. Anyone who refuses a reasonable search may be refused entry or removed where this is reasonably necessary for safety. Any refund will depend on the circumstances and applicable consumer law.
Re-entry: Tickets are valid for one admission only. Re-entry is not normally permitted, but the head steward may allow it for an emergency, a medical need or a reasonable adjustment.
Ticket checks and capacity: Tickets may be shown on a phone or in printed form and must be capable of being scanned. Altered, duplicated, cancelled, previously scanned or fraudulently obtained tickets are invalid. The organiser may temporarily suspend admission or refuse entry where required as a result of an emergency or safety advice, or site capacity, even where a person holds a valid ticket.

3. Prohibited items and activities
The following items and activities are prohibited to protect attendees, staff and the firework safety zones:
Fireworks and pyrotechnics: Attendees must not bring fireworks, sparklers, flares, smoke devices or any other pyrotechnic article onto the event site. Prohibited items may be surrendered to event staff and the attendee may be refused entry or removed. Where appropriate, the matter may be reported to the police.
Alcohol and drugs: Only alcohol purchased from licensed vendors at the event may be consumed on site. Illegal drugs, nitrous oxide and other psychoactive substances are prohibited. Anyone who appears excessively intoxicated or impaired may be refused service, refused entry or removed.
Animals: Pets and other animals are not permitted. Assistance dogs and other assistance animals required by a disabled attendee are welcome, subject to any proportionate restriction required for safety. The display will involve loud explosions and bright flashes; attendees using an assistance animal should consider the animal’s welfare and may contact the organiser in advance to discuss access arrangements.
Drones and commercial recording: Drones and other remotely operated aircraft must not be flown over or near the event site, firing area or fallout zone without the organiser’s prior written permission and all legally required authorisations. Commercial photography, filming or recording also requires prior written permission, which may be granted or refused by the organiser.
Other restricted items: Glass containers, lasers, weapons, barbecues, camping stoves, candles, open flames and any item reasonably considered dangerous are prohibited. Smoking and vaping are permitted only in any area designated by the organiser. Bicycles, scooters, e-scooters and skateboards must not be ridden within the event site.

4. Accessibility, transport and site conditions
Parking and travel: There is no general public parking at Four Marks Recreation Ground. Attendees should use lawful local parking or public transport and must not obstruct nearby roads, driveways or emergency access. Limited accessible parking may be available by prior arrangement. Blue Badge holders and others requiring an access adjustment should contact fofmpta@gmail.com in advance at least five working days in advance where reasonably practicable. Requests received later will still be considered, although the organiser may have less time to arrange an adjustment.
Companion tickets and reasonable adjustments: A disabled attendee who reasonably requires essential assistance may apply in advance for one complimentary companion ticket. The organiser may request reasonable evidence of the access requirement. Examples may include an Access Card showing a +1 symbol, relevant benefit documentation, a Blue Badge where it supports the request, or other appropriate evidence; no single document is mandatory and requests will be considered individually.

Ground conditions: The event takes place on an outdoor grass field. The ground may be uneven, muddy or difficult for wheelchairs, pushchairs and mobility scooters. Attendees should wear suitable footwear and take care. The organiser will provide reasonable access information and adjustments where practicable but cannot guarantee that all areas will be accessible in every weather condition.
Sensory information: The display includes bright and flashing lights, possible strobe effects and very loud explosions. There are no designated quiet zones on site once the main display begins. Attendees with sensory or medical requirements should contact fofmpta@gmail.com in good time before the event so that available adjustments can be discussed.

5. Food, drink and vendor stalls
Independent vendors: Food, drink and other goods may be supplied by independent third-party vendors on their own terms. Questions or complaints about a purchase should first be raised with the relevant vendor. This does not exclude any responsibility the organiser may have under applicable law.
Allergens and dietary requirements: Attendees should ask the individual vendor for current ingredient and allergen information before purchasing. Although vendors are expected to comply with applicable food-safety and allergen requirements, the organiser cannot guarantee an allergen-free environment.
Challenge 25: Licensed bars will operate a Challenge 25 policy. Anyone who appears under 25 may be asked for acceptable proof of age, such as a passport, photocard driving licence or PASS-accredited proof-of-age card. The relevant vendor decides whether identification is acceptable and may refuse service.

6. Fairground rides and attractions
Separate charges: Fairground rides are not included in the event ticket price. Payment is made directly to the relevant ride operator by the methods that operator accepts.
Safety and availability: Riders must follow the operator’s instructions and all height, age, health and other restrictions. A ride operator or the organiser may close or suspend an attraction at any time for safety, weather, mechanical or operational reasons. A ride operator is responsible for the ride services it supplies, without limiting any responsibility the organiser may have under applicable law.
Use of attractions: Attendees use attractions subject to the operator’s lawful conditions and must exercise reasonable care. Nothing in these terms excludes or limits liability where it would be unlawful to do so.

7. Safety, conduct and liability
Safety zones and instructions: Attendees must remain behind safety fencing and barriers and follow all reasonable instructions from stewards, the display operator and emergency services. Entering the firing area, fallout zone or any closed area may result in immediate removal.
Noise and personal precautions: The display will involve very loud explosions and bright flashes. Parents and carers should consider suitable hearing protection for children and anyone sensitive to noise. Attendees should carry any medication they may reasonably need and tell a steward promptly if medical assistance is required.
Conduct and removal: The organiser may refuse entry or remove anyone who acts unlawfully, abusively, dangerously or anti-socially; appears excessively intoxicated; interferes with the event; enters a restricted area; or fails to follow a reasonable safety instruction. No refund will normally be given where refusal or removal results from the attendee’s conduct.
Liability: Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Subject to this, attendees are responsible for taking reasonable care of themselves, accompanying children and their belongings. The organiser is not responsible for loss or damage that was not reasonably foreseeable, was caused by the attendee’s own act or omission, or relates to business activity. Any belongings handed to staff remain at the attendee’s risk unless loss or damage is caused by the organiser’s negligence.
Lost children and vulnerable attendees: Anyone who becomes separated from a child or vulnerable person should notify the nearest steward immediately. Attendees must not interfere with the organiser’s safeguarding arrangements.

8. Photography, filming and privacy
Event photography: Photographs, video and audio may be captured at the event for the PTA’s publicity, fundraising, security and event-record purposes. General crowd images may include attendees incidentally. The organiser will provide appropriate advance and on-site notices and will take particular care with identifiable close-up images of children. Please speak to a steward on arrival if you or a child in your care should not be included in close-up promotional photography. Personal photography is permitted where it is lawful, respectful and not intrusive; commercial recording requires prior written permission.

9. Organiser, enquiries and legal terms
Organiser: The event is organised by Friends of Four Marks School (Registered Charity No: 296536).
Questions and complaints: Questions before the event and complaints afterwards should be sent to fofmpta@gmail.com. Please provide enough information for the organiser to investigate. Complaints should normally be submitted within 14 days after the event.
Governing law: These terms are governed by the law of England and Wales. A consumer may bring proceedings in the courts of the part of the United Kingdom in which they live where applicable.
Severability and statutory rights: If any part of these terms is found to be invalid or unenforceable, the remaining terms will continue to apply. Nothing in these terms affects a consumer’s statutory rights.
